Resumo: A pesquisa visa analisar a possibilidade de incidência do Imposto sobre Serviços (ISS) sobre as atividades realizadas pelos influenciadores digitais na rede social Instagram. Para tanto, a pesquisa inicia com a conceituação de influenciadores digitais e marketing de influência, passando então para a análise das atividades desenvolvidas pelos influencers no Instagram, fazendo uso de imagens, a fim de se verificar se essas atividades são consideradas publicidade. No âmbito jurídico tributário, a pesquisa busca analisar se as atividades realizadas pelos influenciadores são consideradas serviços para fins tributários e a possibilidade de incidência do ISS sobre elas. Com base na análise da Lei Complementar 116/2003, do Decreto-Lei 406/68, do artigo 156, III, §3º, da Constituição Federal (1988), entre outras legislações esparsas e julgados, o trabalho faz breve análise histórica do ISS, passando para o estudo do conceito civilista de serviço e a sua evolução até o conceito constitucional de serviço, desenvolvido pela jurisprudência do Supremo Tribunal Federal. Ademais, a pesquisa realiza a análise dos serviços de publicidade e propaganda que constam na lista anexa à Lei Complementar 116/2003. Metodologicamente, a pesquisa se divide em teórica-sociológica, uma vez que possui como um dos objetos de estudo as relações intersubjetivas firmadas entre os influenciadores digitais, seus seguidores e as marcas contratantes, e jurídico-dogmática já que se propõe a investigar a possibilidade de incidência do ISS nas novas relações firmadas nas redes sociais, se baseando no estudo da literatura e legislações vigentes acerca do tema. Como resultado, conclui-se que as atividades realizadas pelos influenciadores são consideradas publicidade, logo são serviços de publicidade e, portanto, passíveis de incidência do Imposto sobre Serviços.
Resumo em outra língua: This research aims to analyze the possibility of incidence of the Service Tax (ISS) on the activities performed by digital influencers in the social network Instagram. Therefore, the research starts with the conceptualization of digital influencers and influencer marketing, moving then to the analysis of the activities performed by influencers on Instagram, making use of images, in order to verify whether these activities are considered advertising. In the tax legal scope, the research seeks to analyze whether the activities performed by influencers are considered services for tax purposes and the possibility of ISS levy on them. Based on the analysis of Complementary Law 116/2003, of the Decree-Law 406/68, of article 156, III, §3 of the Federal Constitution (1988), among other sparse legislation and judgments, the study makes a brief historical analysis of the ISS, passing through the study of the civilian concept of service and its evolution until the constitutional concept of service, developed by the case law of the Federal Supreme Court. Furthermore, the research performs the analysis of advertising and publicity services contained in the list attached to Complementary Law 116/2003. Methodologically, the research is divided into theoretical-sociological, since it has as one of the objects of study the intersubjective relationships established between digital influencers, their followers and the contracting brands, and legal-dogmatic since it proposes to investigate the possibility of ISS incidence on the new relationships established in social networks, based on the study of literature and current laws on the subject. As a result, it is concluded that the activities performed by the influencers are considered advertising, so they are services if advertising and, therefore, liable to incidence of the Service Tax.
